2. Eligibility

You must be:
- A licensed medical practitioner registered with the appropriate Medical Council of India.
- At least 18 years of age.
- Using the platform only for lawful and professional healthcare purposes.

3. User Responsibilities

You are responsible for maintaining the confidentiality of your account information. You agree to use the Platform in accordance with all applicable laws and regulations.

As a User, you agree:
- To provide accurate, current, and complete information during registration.
- To maintain the confidentiality of your login credentials.
- To comply with all applicable laws, including but not limited to: Clinical Establishments Act, Information Technology Act, ABDM/NDHM standards, HIPAA-equivalent data protection principles.

4. Data Privacy & Confidentiality

We collect and store patient and practice data in line with:
- Indian IT Act (Sec 43A and 72A)
- ABDM/NHA guidelines
- ISO/IEC 27001 certified data protocols All data is encrypted in transit and at rest. You are responsible for obtaining necessary patient consents for data usage.

5. Clinical Responsibility

Live Doctors provides tools to assist in practice management but does not substitute clinical judgment. You remain solely responsible for:
- The content of your prescriptions, diagnoses, consultations, and treatment plans.
- Adhering to MCI, NMC, or other regulatory guidelines.

6. Telemedicine Compliance

You agree to use the teleconsultation feature in accordance with:
- Telemedicine Practice Guidelines 2020 issued by the MoHFW & MCI
- National Medical Commission (NMC) ethics guidelines
- Obtaining prior informed consent before every consultation

7. Billing & Subscriptions

- Subscription fees are outlined in the Pricing page.
- All payments are non-refundable unless explicitly stated.
- Auto-renewals may apply unless cancelled before the billing cycle ends.

8. License & Intellectual Property

- You are granted a non-exclusive, non-transferable license to use the Platform.
- All code, UI/UX, trademarks, and branding are the sole property of PRGENIX.
- You shall not attempt to reverse-engineer, copy, or resell any part of the platform.

9. Prohibited Conduct

You agree not to:
- Use the platform for any unlawful, fraudulent, or abusive purposes.
- Store or transmit harmful code (e.g., malware, ransomware).
- Violate any data privacy regulations or doctor-patient confidentiality.

10. Limitation of Liability

The platform is provided "as-is." We are not liable for:
- Diagnostic errors, data breaches due to user-side issues, or unavailability of the internet.
- Indirect or consequential damages arising from the use of the Platform.
Our maximum liability shall not exceed the total subscription fees paid in the last 6 months.

11. Termination

We reserve the right to suspend or terminate your access in case of:
- Violation of these Terms
- Regulatory or legal requirement
- Non-payment or chargebacks
- Upon termination, your access and data storage privileges will be revoked as per our retention policies.

12. Dispute Resolution

These Terms are governed by Indian Law.
- Any disputes shall be resolved under arbitration in accordance with the Arbitration and Conciliation Act, 1996.

13. Modifications

We may update these Terms from time to time. Continued use after changes implies acceptance. You are encouraged to review them periodically.
